In 2003, the Supreme Court in Lawrence v. Texas has ruled that sexual activity between consensual adults is legal and that state laws prohibiting same-sex sodomy are unconstitutional. Historically, in most cultures, anti-adultery laws were enacted only to prevent women – not men – from having sex with anyone other than their spouse, with adultery often defined as sexual intercourse between a married woman and a man other than her husband. [ref. needed] In many cultures, the penalty was and still is the death penalty, as mentioned below. At the same time, men are free to have sex with all women (polygamy), unless the wives already have husbands or „landlords“. In fact, בעל (ba`al), Hebrew for husband used throughout the Bible, is synonymous with owner. These laws were enacted out of fear of cuckolding and therefore sexual jealousy. Many indigenous customs, such as female genital mutilation[118] and even the menstrual taboo,[119] have been theorized as preventive measures against the cuckold. This arrangement has been deplored by many modern intellectuals. There is concern that the existence of „adultery“ as a criminal offence (and even in family law) may influence criminal proceedings in cases of domestic violence and murder, particularly by mitigating murder to manslaughter[121] or otherwise providing evidence of partial or total defence in cases of violence.

These concerns have been formally expressed in recent years by the Council of Europe and the United Nations. Recommendation Rec(2002)5 of the Committee of Ministers of the Council of Europe to member states on the protection of women against violence states: (…) „57. exclude adultery as an excuse for violence within the family.“ [122] UN Women has also stated with respect to the defense against provocation and other similar defenses that „laws should make it clear that these defenses do not include or enforce honor killings, adultery, domestic violence, or murder.“ [123] „Overview of alimony payments in Nevada,“ In Nevada, a court granting divorce may award alimony to the wife or husband if they cannot afford to pay their own expenses. The courts often pay child support in addition to a division of the couple`s property, especially if one spouse has little or no income. Often, during the marriage, one of the spouses avoided educational or career opportunities to care for the couple`s household and children. Maintenance is awarded when the courts decide that the spouse should be required to have more financial resources to support the spouse with fewer financial resources. Child support payments in Nevada can be periodic, i.e. monthly or annual payments, or lump sums, which are usually a one-time payment. Periodic support generally ends when the beneficiary spouse remarries or when one of the spouses dies. The courts can also only award regular support for a certain period of time or until the recipient spouse is employed. Nevada courts use the following factors to determine whether child support should be awarded: Adultery is not just a crime in your spouse`s eyes. In 21 states, cheating in a marriage is against the law and is punishable by a fine or even imprisonment.

In addition, laws.findlaw.com/US/471/222.html predecessor of 182 was Article VIII, 3 of the Alabama Constitution of 1875, which denied persons „convicted of treason, embezzlement of public funds, abuse of power, theft, bribery, or other crimes punishable by imprisonment“ the right to register, vote, or hold public office.
